These Terms of Service (“Terms”) govern your access to and use of the websites, applications, APIs, widgets, and related services (collectively, the “Service”) provided by Feature Fast LLC, a California limited liability company (“FeatureFast,” “we,” “us,” or “our”). Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you represent that you (a) have read and agree to these Terms and our Privacy Policy, (b) are at least eighteen (18) years of age, and (c) if you are entering into these Terms on behalf of a company or other legal entity, have the authority to bind that entity. If you do not agree, you must not access or use the Service.
2. Definitions
“Service” means the FeatureFast platform, websites, dashboards, APIs, software development kits, and the embeddable widget that captures end-user feature requests. “Customer” means the individual or entity that has registered for and is paying for (or using a free tier of) the Service. “Authorized User” means an employee, contractor, or agent that the Customer has authorized to access the Service. “Customer Data” means any data, content, code, or material submitted to or processed by the Service on behalf of the Customer. “Widget” means the embeddable interface provided by FeatureFast that the Customer may install on its own properties. “End User” means an individual who interacts with the Widget on the Customer’s properties.
3. Account & Subscription
Access to the Service requires an account, which is created and managed through our authentication provider. The Customer is responsible for maintaining the confidentiality of credentials and for all activity that occurs under its account. The Customer must provide accurate, current, and complete information and promptly update its account when information changes. One account is permitted per legal entity or natural person.
4. Subscription Plans, Fees & Billing
FeatureFast offers Free, Solo, and Studio subscription plans, each with the usage limits described on our pricing page. Paid plans are billed in advance through Clerk Billing (which uses Stripe as the payment processor) on a monthly or annual basis depending on the Customer’s selection. Subscriptions automatically renew at the end of each billing cycle unless cancelled. We may change prices on prospective renewals with at least thirty (30) days’ notice by email or in-product notification.
All fees are non-refundable and we do not provide pro-rated refunds for partial billing periods, downgrades, or unused capacity, except where a refund is required by applicable law. The Customer is responsible for all applicable taxes other than taxes based on FeatureFast’s net income.
5. License & Use Restrictions
Subject to these Terms and timely payment of all fees, FeatureFast grants the Customer a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service during the subscription term solely for the Customer’s internal business purposes. The Customer shall not (a) reverse engineer, decompile, or disassemble the Service, (b) resell, sublicense, or commercially exploit the Service, (c) use the Service to build a competing product, (d) use the Service in any high-risk environment where failure could lead to death, personal injury, or environmental damage, or (e) circumvent any usage limits, technical protections, or quotas.
6. Customer Data & GitHub Access
The Customer retains all right, title, and interest in and to Customer Data. The Customer grants FeatureFast a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and otherwise use Customer Data solely as necessary to provide and operate the Service, including by reading the Customer’s connected GitHub repositories, generating pull requests, and serving the Widget.
When the Customer connects a GitHub account, FeatureFast requests only the OAuth scopes required to read repository contents and open pull requests. The Customer may revoke this access at any time through GitHub’s own controls.
FeatureFast does not train, fine-tune, or otherwise improve any artificial intelligence model on Customer Data. FeatureFast uses the Anthropic API to generate code suggestions and pull requests, and per Anthropic’s API terms, Anthropic does not train its models on data submitted to its API.
7. Widget & End-User Submissions
The Widget collects feature requests and other content submitted by the Customer’s End Users. As between the parties, the Customer is the controller of any personal data collected through the Widget, and FeatureFast acts as a processor on the Customer’s behalf. The Customer is solely responsible for (a) providing all required notices to End Users, (b) obtaining all required consents, and (c) responding to End-User rights requests. A data processing addendum incorporating the Standard Contractual Clauses is available on request to support@featurefast.ai.
8. Acceptable Use
The Customer and its Authorized Users shall not use the Service to (a) violate any applicable law or regulation, (b) infringe any intellectual property, privacy, or other right of any third party, (c) transmit malware or other harmful code, (d) send unsolicited communications, (e) impersonate any person or entity, (f) scrape, harvest, or extract data other than as expressly permitted by the Service, or (g) attempt to gain unauthorized access to any system or account.
9. Intellectual Property
FeatureFast and its licensors own all right, title, and interest in and to the Service, including all underlying software, models, documentation, and trademarks. The Customer owns Customer Data. If the Customer provides feedback, suggestions, or ideas regarding the Service, the Customer grants FeatureFast a perpetual, irrevocable, worldwide, royalty-free license to use that feedback to improve the Service. FeatureFast will not use feedback or any Customer Data to train external artificial intelligence models.
10. Third-Party Services & Subprocessors
The Service relies on certain third-party services and subprocessors. A current list is available at /subprocessors. The Customer’s use of those services in connection with the Service is also subject to the applicable third-party terms.
11. Confidentiality
Each party (the “Receiving Party”) shall protect the other party’s confidential information with the same degree of care it uses to protect its own confidential information of like kind, but in no event less than a reasonable standard of care, and shall use confidential information only as necessary to perform under these Terms. These obligations do not apply to information that is (a) publicly known through no breach of these Terms, (b) lawfully received from a third party without confidentiality obligations, (c) independently developed without use of the disclosing party’s confidential information, or (d) required to be disclosed by law, provided the Receiving Party gives reasonable notice where legally permitted.
12. Term, Suspension & Termination
Subscriptions are month-to-month (or annual, if selected) and either party may cancel at any time, with cancellation taking effect at the end of the then-current billing cycle. FeatureFast may suspend or terminate the Service immediately if the Customer (a) fails to pay any amount due for more than fourteen (14) days, (b) materially breaches these Terms, or (c) abuses the Service in a manner that risks harm to FeatureFast, other customers, or third parties. On termination, the Customer may export Customer Data for up to thirty (30) days, after which FeatureFast may delete or anonymize that data in the ordinary course of business.
13. Disclaimers
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND FEATUREFAST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FEATUREFAST DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED OUTPUT MAY BE INCORRECT, INCOMPLETE, OR UNSAFE; THE CUSTOMER IS SOLELY RESPONSIBLE FOR REVIEWING ANY PULL REQUEST OR OTHER OUTPUT BEFORE MERGING OR ACTING ON IT.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEATUREFAST’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE FEES PAID BY THE CUSTOMER TO FEATUREFAST IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY. IN NO EVENT WILL EITHER PARTY BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA. THESE LIMITATIONS DO NOT APPLY TO (i) GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, (ii) A PARTY’S INDEMNIFICATION OBLIGATIONS, OR (iii) THE CUSTOMER’S OBLIGATION TO PAY FEES.
15. Indemnification
The Customer shall defend, indemnify, and hold harmless FeatureFast and its officers, employees, and agents from and against any third-party claims arising from (a) Customer Data, (b) the Customer’s repository content or end-user submissions, (c) the Customer’s breach of these Terms, or (d) the Customer’s use of the Service in violation of law. FeatureFast shall defend the Customer against any third-party claim alleging that the Service, as provided by FeatureFast and used in accordance with these Terms, infringes the third party’s intellectual property rights, and will pay damages finally awarded against the Customer for that claim.
16. Modifications to Terms
FeatureFast may modify these Terms from time to time. For material changes, FeatureFast will provide at least thirty (30) days’ notice by email or in-product notification before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. The parties agree to first attempt to resolve any dispute informally by contacting support@featurefast.ai. If a dispute cannot be resolved within sixty (60) days, the parties shall submit to non-binding mediation in San Francisco County, California. Any unresolved dispute shall be brought exclusively in the state or federal courts located in San Francisco County, California, and the parties consent to personal jurisdiction there.
18. Miscellaneous
The Customer may not assign these Terms without FeatureFast’s prior written consent; FeatureFast may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all of its assets. Neither party will be liable for any failure to perform due to causes beyond its reasonable control. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and any order forms or subscription confirmations, constitute the entire agreement between the parties regarding the Service. No waiver of any provision will be effective unless in writing and signed by the waiving party.
